1. Acceptance of Terms

Welcome to YouthfulDNA® (“YouthfulDNA,” “we,” “us,” or “our”).

These Terms of Service (“Terms”) govern your access to and use of the YouthfulDNA® website, products, DNA collection kits, genetic reports, educational content, customer portals, and related services (collectively, the “Services”).

By accessing or using the Services, creating an account, or purchasing a product or Service, you acknowledge that you have read and agree to these Terms and the policies incorporated into them.

If you do not agree to these Terms, do not use the Services.

Acceptance of these Terms does not, by itself, constitute consent to genetic testing or to any collection, analysis, storage, use, maintenance, disclosure, transfer, or other processing of genetic information for which separate consent is required.

Genetic-testing consent is handled separately as described in the YouthfulDNA® Genetic Privacy Notice and applicable consent materials.

2. Eligibility and Your Own Sample

YouthfulDNA® genetic-testing Services are intended only for individuals age 18 or older.

By purchasing, registering, or using a YouthfulDNA® genetic-testing Service, you represent that:

• You are at least 18 years old;
• You have legal capacity to enter into these Terms;
• The biological sample submitted is your own; and
• Information you provide is accurate to the best of your knowledge.

Do not submit another person’s biological sample for YouthfulDNA® testing.

YouthfulDNA® may suspend or decline processing if it reasonably believes that applicable age, identity, sample-ownership, authorization, consent, or other legal requirements have not been satisfied.

3. Description of the Services

YouthfulDNA® is a wellness-focused genetics company that provides personalized educational and informational genetic insights.

Services may include genetic insights concerning skin health and other wellness-related areas offered by YouthfulDNA® from time to time.

YouthfulDNA® currently uses selected genetic information to provide personalized educational insights and may offer additional genetic reports that can be generated from existing genetic information.

The Services are intended for educational, informational, and wellness purposes.

YouthfulDNA® is not a healthcare provider and is not a clinical laboratory.

The Services are not intended to diagnose, treat, cure, mitigate, monitor, or prevent disease or medical conditions.

4. Genetic-Testing, Laboratory, Technology, and Other Providers

YouthfulDNA® may use authorized third-party providers for aspects of the Services, including:

• DNA kit fulfillment;
• Shipping and logistics;
• Kit registration;
• Biological-sample processing;
• Genotyping;
• Genetic analysis;
• Report generation;
• Technology infrastructure;
• Customer portals;
• Report delivery;
• Payment processing;
• Digital-wallet services;
• Financing or buy-now-pay-later services;
• Customer communications;
• Security; and
• Other operational functions.

Certain portions of the customer experience therefore may occur through systems or technology operated by authorized providers.

YouthfulDNA® may change providers, laboratories, technologies, fulfillment partners, or other service providers when reasonably necessary to operate or improve the Services.

Genetic information and consumer health information will be handled in accordance with applicable law, applicable consent, the YouthfulDNA® Privacy Policy, Genetic Privacy Notice, and Consumer Health Data Privacy Policy.

Nothing in these Terms releases an authorized provider from obligations or responsibility imposed directly on that provider by applicable law.

5. Sample Collection, Processing, and Results

Customers are responsible for following the collection and return instructions supplied with the DNA collection kit.

A sample may be unable to be successfully processed because of circumstances including:

• Insufficient biological material;
• Contamination;
• Collection error;
• Damage;
• Improper handling;
• Shipping problems; or
• Other laboratory or quality-control issues.

If a sample cannot be successfully processed, the YouthfulDNA® Refund Policy and its sample-failure provisions will apply.

Results are typically available within 10–15 business days after the laboratory receives your sample.

This timing is an estimate and is not a guaranteed delivery date.

Delays may result from shipping, laboratory operations, quality-control requirements, technical issues, extraordinary events, or other circumstances outside YouthfulDNA®’s reasonable control.

6. Separate Genetic Consent

Genetic testing requires separate affirmative authorization or express consent where required by applicable law.

Your purchase of a DNA kit, acceptance of these Terms, acceptance of the Privacy Policy, or use of the website does not replace any required genetic-testing consent.

Where required by applicable law, separate consent may also be required for activities such as:

• Continued biological-sample storage following completion of requested testing;
• Secondary uses of genetic information;
• Research;
• Certain transfers or disclosures;
• Certain marketing involving genetic information or genetic-testing participation; or
• Additional reports when the new genetic use falls outside the scope of prior consent.

You may withdraw or revoke applicable consent as permitted by law.

Withdrawal of consent may affect our ability or the ability of authorized providers to complete testing, maintain access to reports, retain certain information, or provide future genetic Services.

Withdrawal of genetic consent does not by itself create a right to a refund, except as provided in Section 9, the YouthfulDNA® Refund Policy, or applicable law.

7. Educational and Non-Medical Nature of the Services

YouthfulDNA® genetic reports and educational materials are not medical advice.

YouthfulDNA® does not provide:

• Medical diagnosis;
• Disease screening;
• Medical treatment;
• Prescription guidance;
• Individualized medical care; or
• A physician-patient relationship.

Genetic tendencies are not diagnoses and do not establish that a particular outcome will occur.

Genetics is one of many factors that may influence skin and wellness characteristics.

Environmental exposure, lifestyle, age, nutrition, medications, skincare, health history, and other factors may also influence outcomes.

Do not start, stop, or modify medication, treatment, medical care, or other clinically significant health decisions solely on the basis of YouthfulDNA® information.

Consult an appropriately qualified healthcare professional regarding medical concerns.

8. Pricing, Orders, Payments, Digital Wallets, and Financing

Prices displayed at checkout at the time an order is placed govern that transaction, subject to correction of obvious pricing or technical errors.

YouthfulDNA® may offer promotional or discounted pricing from time to time.

YouthfulDNA® may use:

• Payment processors;
• Digital-wallet providers; and
• Financing or buy-now-pay-later providers.

By submitting a payment method, you represent that you are authorized to use that payment method and authorize the applicable payment provider to process charges associated with your purchase.

Financing or buy-now-pay-later transactions may also be governed by separate terms between you and the applicable financing provider.

YouthfulDNA® does not control independent credit approval, financing terms, payment schedules, interest, fees, or other financial terms imposed by a third-party financing provider.

Any required genetic-privacy disclosure or genetic-testing consent is separate from payment authorization.

Where applicable law requires genetic-privacy disclosures or other genetic-testing disclosures before payment is accepted, those disclosures must be presented before payment may be completed. Payment authorization does not substitute for genetic-testing consent.

9. YouthfulDNA® 90-Day Confidence Guarantee and Refunds

Refunds for the YouthfulDNA® Skin Health DNA Test are governed by the YouthfulDNA® Refund Policy — 90-Day Confidence Guarantee.

The principal terms are summarized below for convenience.

If this summary conflicts with the Refund Policy, the Refund Policy controls.

Before Your Sample Is Submitted

You may request a full refund within 90 days of purchase if your DNA sample has not been submitted.

For purposes of the Refund Policy, “submitted” means the DNA sample has been handed to the designated return carrier, laboratory, or other authorized facility for processing.

Opening the shipping box, opening the collection kit, registering the kit, reviewing the instructions, or beginning the collection instructions does not, by itself, make the purchase non-refundable.

If an order can be canceled before shipment, YouthfulDNA® may cancel shipment and issue the applicable full refund.

If the kit has already shipped, the purchase may remain eligible for the guarantee if the refund request is made within 90 days of purchase and the sample has not been submitted.

Eligible refunds include applicable sales tax and are not reduced by outbound-kit shipping charges.

After Your Sample Is Submitted

Once your DNA sample has been submitted, the purchase price is generally non-refundable except under the sample-failure guarantee, applicable law, or another expressly stated exception in the Refund Policy.

Sample-Failure Guarantee

If YouthfulDNA® is unable to successfully process the initial sample, YouthfulDNA® will provide:

One replacement DNA collection kit;

Associated shipping for the replacement kit and return of the replacement sample; and

One additional processing attempt

without additional charge.

If the replacement sample also cannot be successfully processed and YouthfulDNA® cannot deliver the purchased personalized Skin Health DNA report, the applicable purchase amount will be refunded without requiring any further processing attempt.

Completed Reports

Once the purchased report or Service has been completed, it is generally non-refundable except where applicable law requires otherwise.

Damaged, defective, incomplete, or lost kits may be replaced as described in the Refund Policy and do not automatically eliminate applicable rights under the guarantee.

Promotional or discounted eligible DNA purchases remain subject to the guarantee unless different terms are clearly disclosed at or before purchase.

Any refund is based on the amount actually paid.

Additional genetic reports, memberships, skincare, digital products, bundles, or future Services may have separate refund terms disclosed at or before purchase.

Refund processing and timing may vary based on the original payment method, financing provider, financial institution, or digital-wallet provider.

10. Additional Genetic Reports and Future Services

YouthfulDNA® may offer additional genetic reports, wellness insights, memberships, digital products, educational content, or other Services in the future.

Certain additional genetic reports may be generated from genetic information already produced from your existing DNA sample, meaning another biological sample may not be necessary.

YouthfulDNA® will generate such an additional report only when:

• You request or appropriately authorize the report;
• The use falls within the scope of applicable prior consent; or
• Additional consent is obtained where required by applicable law.

Purchasing one genetic report does not automatically entitle you to all future reports or authorize every future use of your genetic information.

Future Services may carry additional fees, terms, consent requirements, refund conditions, or eligibility requirements.

YouthfulDNA® does not guarantee that any announced, contemplated, or future Service will become available.

11. De-Identified Information and Research

YouthfulDNA® does not sell identifiable customer genetic information for research, advertising, or unrelated commercial purposes.

YouthfulDNA® or authorized genetic-testing and technology providers may create, maintain, or use appropriately de-identified or anonymized information where permitted by applicable law, applicable consent, and applicable contractual arrangements.

Such information may be used for purposes described in the Privacy Policy and Genetic Privacy Notice, including certain improvements to genetic-analysis methods, algorithms, reports, technology, quality, or Services where legally permitted.

YouthfulDNA® does not use identifiable customer genetic information or biological samples for independent commercial research without appropriate authorization or consent where required.

If YouthfulDNA® offers a research program in the future, participation will be voluntary and subject to applicable disclosure and consent requirements.

12. Your Responsibilities

You agree to:

• Provide accurate and current information;
• Submit only your own biological sample;
• Follow applicable collection and shipping instructions;
• Maintain the confidentiality of your account credentials;
• Promptly notify YouthfulDNA® of suspected unauthorized account access;
• Use the Services only for lawful personal purposes;
• Comply with applicable laws; and
• Respect intellectual-property and privacy rights.

You are responsible for deciding whether and with whom to share your genetic reports or downloaded genetic information.

Once you download, send, publish, or otherwise disclose information outside systems controlled by YouthfulDNA® or its authorized providers, YouthfulDNA® may no longer be able to control the privacy, security, further use, or redistribution of that information.

13. Prohibited Uses

You may not:

• Submit another person’s biological sample;
• Misrepresent your identity or age;
• Obtain genetic information about another person without lawful authority;
• Use the Services for unlawful discrimination;
• Attempt unauthorized access to accounts, systems, portals, or data;
• Introduce malware or interfere with operation of the Services;
• Reverse engineer or improperly extract proprietary software, algorithms, or protected technology;
• Resell or commercially exploit reports or Services without authorization; or
• Use the Services for any unlawful purpose.

14. Intellectual Property

YouthfulDNA® owns or licenses the intellectual-property rights in the YouthfulDNA® website, brand, trademarks, original content, graphics, marketing materials, and other materials created by or specifically for YouthfulDNA.

Certain genetic-testing technology, laboratory methods, report-generation systems, report content, software, databases, algorithms, and other materials used to provide the Services may be owned or licensed by third-party genetic-testing, laboratory, technology, or content providers.

Nothing in these Terms transfers ownership of third-party provider intellectual property to YouthfulDNA® or to you.

Subject to these Terms, YouthfulDNA® grants you a limited, personal, non-exclusive, non-transferable right to access and use the Services and reports provided to you for your own lawful personal use.

You may retain a personal copy of your genetic report.

You may not reproduce, resell, commercially distribute, reverse engineer, or use protected YouthfulDNA® or provider materials to create a competing product or service except where expressly authorized or legally permitted.

These Terms do not alter rights you have in your own personal information, genetic information, or biological sample under applicable law.

15. Genetic Information and Nondiscrimination Laws

Federal and state laws may provide protections concerning genetic information.

The federal Genetic Information Nondiscrimination Act (“GINA”) generally restricts certain uses of genetic information in health insurance and employment.

GINA does not provide identical protection in every context and generally does not provide the same protections for areas such as life insurance, disability insurance, or long-term-care insurance.

Additional state laws may provide broader protections.

YouthfulDNA® does not provide legal or insurance advice.

You should consider applicable privacy and insurance implications when deciding whether to obtain, download, or share genetic information.

16. Genetic Testing and Scientific Limitations

Genetic testing has limitations.

YouthfulDNA® Services analyze selected genetic information relevant to the reports purchased or requested.

They do not examine every gene, genetic variant, biological pathway, environmental influence, or other factor potentially relevant to a trait or outcome.

Results and interpretations may be affected by:

• Available scientific research;
• Population representation in research;
• Genotyping or laboratory limitations;
• Statistical associations;
• Data-quality limitations; and
• Evolving scientific understanding.

Different genetic-testing companies may analyze different genetic markers or use different technologies or methodologies and therefore may produce different results or interpretations.

Scientific knowledge can change over time.

YouthfulDNA® does not guarantee that an existing report will automatically be updated or reinterpreted whenever new research becomes available.

Unexpected Information

Genetic testing may reveal information you did not expect.

Genetic information may also have implications for biological relatives or family relationships.

You should consider these possibilities before using genetic-testing Services or sharing genetic information.

17. No Guarantee of Outcomes

YouthfulDNA® does not guarantee that:

• A report will produce any particular health, skin, cosmetic, lifestyle, or wellness outcome;
• Any skincare, nutritional, lifestyle, ingredient, or wellness consideration will produce a particular result;
• A genetic tendency will manifest in a particular way; or
• Information or interpretations will remain unchanged as scientific understanding develops.

Individual outcomes vary.

18. Disclaimer of Warranties

To the fullest extent permitted by applicable law, the Services are provided on an “as available” basis without warranties beyond those expressly provided by YouthfulDNA® or required by law.

YouthfulDNA® does not warrant uninterrupted website access or that every technological component will continuously be free from errors, interruptions, or temporary unavailability.

Nothing in these Terms excludes warranties, guarantees, remedies, or consumer rights that cannot lawfully be excluded.

19. Limitation of Liability

To the fullest extent permitted by applicable law, YouthfulDNA® will not be liable for indirect, incidental, special, exemplary, consequential, or punitive damages arising from use of the Services.

To the fullest extent permitted by applicable law, YouthfulDNA®’s aggregate liability for a claim arising from a particular purchased product or Service will not exceed the amount actually paid to YouthfulDNA® for that product or Service.

These limitations do not apply where prohibited by applicable law and do not eliminate rights or remedies that cannot legally be waived.

Nothing in these Terms releases an independent provider from responsibility that applicable law imposes directly on that provider.

20. Indemnification

To the extent permitted by applicable law, you agree to indemnify and hold YouthfulDNA® harmless from claims, liabilities, losses, damages, and reasonable expenses arising from:

• Your material violation of these Terms;
• Your unlawful misuse of the Services;
• Your submission of information or biological material that you had no legal right to provide; or
• Your violation of another person’s rights or applicable law.

This section does not require indemnification where such indemnification would be prohibited by applicable law.

21. Suspension or Termination

YouthfulDNA® may suspend or terminate access to all or part of the Services where reasonably necessary because of:

• Violation of these Terms;
• Fraud or suspected fraud;
• Security concerns;
• Unauthorized sample submission;
• Unlawful activity;
• Misuse of the Services; or
• Legal or regulatory requirements.

Suspension or termination does not eliminate privacy, genetic-data, refund, consumer-health-data, or other rights that remain applicable under law or the policies governing the transaction.

22. Governing Law and Disputes

These Terms are governed by the laws of the State of Florida, without regard to conflict-of-law principles, except where another jurisdiction’s law must apply and cannot legally be waived.

Before filing a lawsuit, the parties are encouraged to attempt in good faith to resolve the dispute informally.

Subject to applicable law and any non-waivable jurisdictional rights, disputes arising from these Terms may be brought in a state or federal court having appropriate jurisdiction in Florida.

These Terms do not require mandatory arbitration and do not contain a class-action waiver.

Nothing in this section prevents a consumer from exercising statutory rights, filing complaints, or seeking relief through an applicable governmental or regulatory authority.

23. Changes to These Terms

YouthfulDNA® may update these Terms to reflect changes in Services, business operations, technology, policies, or applicable law.

The “Last Updated” date identifies the most recent revision.

Material changes may be communicated through a prominent website notice, email, account notification, or another appropriate method.

Where applicable law requires affirmative acceptance, authorization, or consent before a particular change may apply, YouthfulDNA® will obtain that acceptance, authorization, or consent.

An updated version of these Terms does not, by itself, authorize a new or materially different use of genetic information or biological samples where separate consent is required.

24. Business Transfers and Changes of Control

If YouthfulDNA® is involved in a merger, acquisition, restructuring, bankruptcy, sale of assets, financing transaction involving a transfer of control, or similar business transaction, personal information, genetic information, biological-sample information, and consumer health data will remain subject to applicable law, applicable consent, contractual restrictions, and the YouthfulDNA® Privacy Policy, Genetic Privacy Notice, and Consumer Health Data Privacy Policy.

Nothing in a business transaction automatically authorizes a use, disclosure, transfer, or sale of genetic information or consumer health data that would otherwise require additional notice, authorization, or consent under applicable law.

Where required by applicable law, YouthfulDNA® will provide applicable notice or obtain required consent before a covered transfer occurs.

25. Relationship to Other Policies and Entire Agreement

These Terms should be read together with the YouthfulDNA®:

• Privacy Policy;
• Genetic Privacy Notice;
• Consumer Health Data Privacy Policy;
• Refund Policy; and
• Medical & Genetic Disclaimer.

The Refund Policy controls specific refund eligibility and refund procedures.

The Genetic Privacy Notice and any applicable specific genetic-testing consent control where they provide more specific requirements concerning genetic information, biological samples, or genetic consent.

The Consumer Health Data Privacy Policy controls where it provides greater or more specific protection concerning consumer health data.

The Medical & Genetic Disclaimer provides additional information concerning the educational, informational, scientific, and non-medical nature and limitations of the Services.

If two incorporated policies address the same issue differently, the more specific policy governing that subject will control, except where applicable law requires a different result.

If any provision of these Terms is determined to be invalid or unenforceable, the remaining provisions will remain effective to the fullest extent permitted by law.

These Terms and the policies incorporated into them constitute the agreement governing use of the Services, subject to any separate transaction-specific terms or consent document that expressly applies.
